You have three sources of instruction to consider when deciding whether or not to use the new subsequent observation codes (99224-99226, subsequent observation care, low, moderate and high severity respectively). CMS has one policy, CPT is introducing another and private payers such as Aetna aren’t necessarily bound to either one, though Aetna has chosen to side with Medicare (see
