A federal judge in Florida on Monday ruled the Patient Protection and Affordable Care Act (PPACA) is unconstitutional. This action, however, won’t eliminate sections of the bill already implemented by CMS. You can keep providing annual wellness visits and waiving copays and deductibles for certain preventive services covered by Medicare.
Image from www.whitehouse.govThere weren't any big surprises where health care and Medicare were concerned during the hour-long State of the Union address last night. President Obama made it clear that the health reform law will not be repealed, only tweaked for improvement. He also hinted again at the possibility of his support for malpractice reform as a way to bring down costs.

"I'm willing to look at other ideas to bring down costs, including one that Republicans suggested last year -- medical malpractice reform to rein in frivolous lawsuits," he said. It was a remark that drew Republican applause, but did not strengthen earlier committments he made to the idea of malpractice reform.

U.S. CapitolDebate on repealing the Patient Protection and Affordable Care Act of 2010 will begin with consideration of H.R. 2 -- Repealing the Job-Killing Health Care Law Act of 2011 (pdf) -- this afternoon. Following its probable passage this week, the House will consider another resolution that instructs committees “to report legislation replacing the job-killing health care law” (pdf).
