CMS has addressed its recent demand letters and recoupments on claims for patients technically incarcerated at time of service in a new FAQ.
 
The FAQs refer to CMS’ recent update admitting that the information they were using for the takebacks "was, in some cases, incomplete," as readers of Part B News know. CMS does not say in the FAQ that affected providers don't have to pay or appeal -- but they do suggest a late appeal request might be appropriate: "Incorrect information from CMS or its contractors about when or how to file an appeal request," the FAQ says, "is an example of good cause for CMS to waive the appeal deadline."
