While all Medicare providers should be interested in the prospective change to physician payments in Congress’ pending budget bill, there are a few other pieces of the bill that would affect them indirectly. Medicaid and Affordable Care Act (ACA) cuts, for example, appear to increase the number of uninsured and threaten at-risk hospitals. Also, the sequestration cut isn’t going up — or going away.

The budget bill signed into law on July 4 adds a 2.5% raise to the physician fee schedule (PFS). But because the law increases the deficit, other laws previously passed by Congress mandate an increase in the sequestration cuts to Medicare revenue from the current 2% to 4% — and potentially higher — unless a new law is passed to cut it off. Other impacts on Medicare practices, including a reduction in covered patients, also are expected.

Some Medicare Advantage payers are passing along the 2% sequester cut to providers. Experts say that, in some cases, they shouldn’t — but it will be difficult to challenge the pass-through, especially if you haven’t been careful about the language in your contracts.

As CMS re-ups the 2% sequestration cut on provider payments, now is a good time to check your private and Medicare Advantage contracts to make sure those payers aren’t taking that cut without cause.
