Sen. Marco RubioR-Fla., has indicated it is time for another vote to repeal the ACA. Should such a vote be successful, it would spare health care providers the trouble of having to implement a compliance plan.

Section 6401 of the ACA -- an often-forgotten provision -- requires that all providers and suppliers, regardless of their size, institute formal compliance programs. New practices will no longer be able to enroll in Medicare or Medicaid without a compliance program in place, and already existing practices also will be expected to institute them.”

We flipped through back issues of Medical Practice Compliance Alert and found that when the ACA was released, experts predicted that HHS would issue a model plan that was difficult to distinguish from the OIG’s long standing model compliance plans. As to whether being required to implement a plan will be a big burden for providers, including physician practices, we’re not so sure.
